The project, a joint venture between EDF and Shell, has a potential capacity of up to 2.8 GW. This move follows a petition from environmental group Save Long Beach Island, which challenged the project's permits. The Department of Justice's filing requests the court to remand the COP and Record of Decision to the permitting agency for further review and to stay the ongoing litigation during this process.
In related developments, the New Jersey Board of Public Utilities (NJBPU) has terminated the Offshore Renewable Energy Certificate (OREC) agreement for the Atlantic Shores South project. This decision follows a petition submitted by Atlantic Shores on June 4, 2025, requesting the termination of its OREC award.
